Terms & Conditions
These Terms of Service (“TOS”) form a legally binding agreement between Get ORM (“the Company”) and you, the Client (“Client”). By engaging with Get ORM’s services, visiting our website (“Site”), or communicating with us in any manner, you agree to be bound by these TOS. If you do not agree with these terms, you are not permitted to use our services.
1. Services Provided
Get ORM offers online reputation management services, including content removal, suppression, search engine optimization (SEO), content creation, and crisis management. Our goal is to help clients improve their online presence by removing harmful content or promoting positive content. However, we do not guarantee specific outcomes, as results depend on various factors outside of our control, including third-party platform policies and actions.
2. Client Approval Process
For content creation services, the Company may, at its discretion, provide the Client with an opportunity to review and approve content before it is published. If approval is required, the Client will be given a specified period to review the content (typically up to 5 days unless otherwise agreed). Failure to respond within the designated period may result in the Company proceeding with publication or delaying services, for which the Company will not be liable. The Company retains the right to make final decisions on content dissemination.
3. Payment and Refund Policy
Payment terms, including pricing and payment schedules, are outlined in the specific agreement or proposal provided to the Client. The Company may require upfront payments, deposits, or operate on a pay-per-removal basis, depending on the nature of the services provided. Refunds are not guaranteed and are handled on a case-by-case basis. Once services commence, all payments are generally non-refundable, except under circumstances expressly agreed upon by the Company.
4. Content Removal and Suppression
While the Company strives to remove or suppress harmful content, we cannot guarantee success due to factors outside our control, such as the decisions of third-party platforms. If content is successfully removed but later reinstated or reposted, additional fees may apply for subsequent removal efforts, as each instance is treated as a separate scope of work.
5. Client Obligations and Warranties
-
The Client agrees to provide accurate and complete information necessary for the Company to perform the services.
-
The Client warrants that all content provided for use in services does not infringe on the rights of third parties, including intellectual property, privacy, or other legal rights.
-
The Company will not contact the original author of any harmful content without explicit written authorization from the Client.
6. Confidentiality and Intellectual Property
-
Both parties agree to keep all exchanged information confidential and not to disclose it to third parties except as required to perform the services or as required by law.
-
The Client retains ownership of any materials provided to the Company, while the Company retains ownership of its methods, strategies, and proprietary information developed during service delivery.
7. Limitation of Liability
-
The Company is not liable for indirect, incidental, or consequential damages arising from the use of its services, including but not limited to lost profits, reputational harm, or business interruptions.
-
The Company’s total liability for any claim related to the services will not exceed the amount paid by the Client for the specific service in the 12 months preceding the claim.
8. Governing Law and Dispute Resolution
These TOS and any disputes arising from them will be governed by the laws of the State of New York, without regard to conflict-of-law principles. Any disputes that cannot be resolved amicably shall be settled by binding arbitration in New York, NY.
9. Amendments to Terms
The Company reserves the right to modify these TOS at any time without prior notice. Any changes will be posted on the Site, and continued use of the services constitutes acceptance of the modified terms.
